You do not have to have an Illinois marriage license to file for divorce in Illinois. Typically, however, you must reside in Illinois for 90 days before filing. You may also file for divorce in Illinois if your spouse resides here and you do not. As in all divorce proceedings, proper notification of your spouse is required. If the spouse cannot be located, there are public measures that must be taken.

An interstate divorce may cause issues over jurisdiction or venue if many matters in the case are contested. In some instances, the laws of one state may be more advantageous to one part over another.
